CASSATION: EVEN MOTHER CAN GIVE HER SURNAME TO CHILD
(AGI) – Rome, May 29 – The father’s surname is not to be imposed if it damages the right of the offspring to him/herself. The Court of Cassation makes a step towards parity between men and women in families.
With an unprecedented ruling, the Cassation stated that the automatic assignment of the father’s surname is “no longer a current issue”, since families are no longer based on the patriarch model. The first civil section of the Cassation thus rejected the appeal of a father, who recognised his natural child ‘late’, asking that he be given his surname instead of the mother’s one.(AGI) .
